What is WILMOTH Group's Eviction Process?

WILMOTH Group will represent it’s owners when an eviction is needed. The cost of the court filing and attorney average $400. Different courts will cost different amounts.  

This cost also includes filing for damages. Those hearings usually are about 60 days later. WILMOTH Group will submit to the court a statement of unpaid rent and a list of damages (taken from a move-in inspection if available). Damages are awarded after the court reviews these expenses and subtracts any security deposit held.

WILMOTH Group begins a collections process for past due rent on the 6th of each month. This collection process involves communications with the delinquent tenant by phone, email and text. We attempt to find agreeable solutions and monitor the tenant’s performance to these solutions.

In situations where the tenant does not cooperate or communicate with our daily correspondence about payment, we move from a collections process to a Pay Rent or Quit Notice. This occurs by the 25th of the month. The posting allows the tenant 5 business days to reconcile their delinquency.

When there is no success from the Pay Rent or Quit Posting, the next action is to file for eviction (also called possession). WILMOTH Group will represent it’s owners when an eviction is needed. The cost of the court filing and attorney average $350. Different courts fees will create different amounts of charges. Evictions hearings are scheduled by the local courts and we are at the court’s mercy as to how long we must wait for a hearing. On average, most hearings are scheduled within a 30 day window.

This cost of the eviction legal and filing also includes filing for damages. Those hearings usually are about 60 days after the eviction hearing. The final step is we turn over any damages judgement received against the former tenant to a collection agency. The success of collection is improved with the better the background information on the tenant. When WILMOTH Group places the tenant, we have a complete background which provides the highest probability of some collection of damages.
